Although unable to shake the five witnesses, the judges still have Nephi arrested and question him. If he can be executed as a criminal, then his prophecy need not be taken seriously. They have already decided on this verdict but feel compelled to go through the interrogation, probably because of the publicity attending the five, especially since, now released from prison, they would have been telling their tale and bearing their testimony far and wide.
